AUSTRIA (UST / MWST)

Austria  being an EU member state falls under the EU VAT regime. Member states must adopt EU VAT Directives into their own legislation.

VAT Registration

A non-resident taxable person that maintains a fixed establishment in Austria or supplies goods or services in Austria or performs taxable intra-Community acquisitions, is obliged to register for VAT purposes in Austria and will, in case of a non-EU business, require a fiscal representative in some cases.

VAT Compliance

Detailed rules regulate reporting requirements of Austrian transactions for Value Added Tax purposes. These include: invoice requirements, timeliness for an invoice to be issued, invoice and credit notes corrections rules, foreign currency reporting requirements and exchange rate sources, correction of previously submitted returns and accounting records that must be maintained for VAT purposes.

VAT Returns

Businesses normally file their VAT returns monthly, unless in the preceding calendar year, sales did not exceed EUR 22,000, in which case they can file quarterly VAT returns.
Taxable persons are obliged to submit monthly VAT returns to the competent Austrian tax office if their supplies within the scope of Austrian VAT law (taxable and exempt) exceeded EUR 100,000 in the previous calendar year.

All businesses must file a recapitulative annual return.

The VAT return is due on the 15th day of the second month following the tax period. The annual return has to be filed by 30 June of the following year.

Intrastat and EC Sales Lists

The Intrastat discloses details of movements of goods between Member States which take place for commercial reasons, recording the movement whenever goods enter the territory of Austria from other Member States or leave it for other Member States.


Declaration must be filed monthly once the annual threshold is exceeded.

Intrastat declarations can be submitted either in paper format or in electronic form. The due date for submission is the 10th working day following the reference period.
